The Federal Ombudsman for Protection Against Harassment (FOSPAH) has imposed a collective fine of Rs2.7 million on five employees of a private company after finding them guilty of workplace harassment and retaliatory conduct against a female employee.
The decision came after an investigation into a complaint that detailed repeated incidents of inappropriate behavior and retaliation inside the workplace. The ruling also directed the company to strengthen its internal anti-harassment mechanism to prevent similar incidents in the future.
Female Employee Reported Repeated Harassment
According to the complaint, several senior officials allegedly subjected the female employee to inappropriate conduct during her employment.
The complainant stated that she received unwanted invitations for meetings outside the office. She also alleged inappropriate physical contact and derogatory remarks from multiple executives.
After experiencing the alleged misconduct, she attempted to report the matter through the company’s internal complaint process.
Internal Complaint Process Failed
According to the case record, the company’s internal mechanism failed to address her concerns effectively.
One official allegedly failed to preserve important CCTV footage that could have supported the investigation. Meanwhile, other officials reportedly retaliated against the complainant after she raised the issue.
As the situation worsened, she was ultimately forced to resign from her position. In addition, her outstanding dues were allegedly withheld.
Ombudsman Rejects Defense Arguments
During the proceedings, the accused officials attempted to question the complainant’s personality and attire.
However, the Federal Ombudsman firmly rejected those arguments.
The verdict stated that a woman’s personality or social behavior cannot be used as a defense against harassment allegations.
The ruling further emphasized that “politeness does not equal consent.”
It also stated that “a safe work environment is a fundamental duty of the employer.”
Forensic Evidence Supported the Complaint
The Ombudsman reviewed witness statements and forensic evidence before delivering the final decision.
After examining the available evidence, the authority confirmed both workplace harassment and retaliatory conduct against the complainant.
As a result, the five officials received a combined fine of Rs2.7 million.
The ruling reflects the legal consequences for workplace misconduct and reinforces the responsibility of employers to protect employees from harassment.
Company Ordered to Strengthen Anti-Harassment Measures
Besides imposing financial penalties, the Federal Ombudsman also directed the private company to improve its internal compliance measures.
The institution has been ordered to reconstitute its anti-harassment committee within 30 days.
The directive aims to ensure that future complaints receive proper handling in accordance with legal requirements.
