Wife Files Fraud Case Over Vehicle Sale
The Lahore High Court has granted interim bail to a man accused by his wife of fraud for allegedly selling a car she claimed was part of her dowry.
Justice Tariq Mahmood Bajwa issued the order on the bail petition of Muhammad Umair Riaz. The case was registered after his wife accused him of selling a vehicle that remained registered in her name.
According to the court order, the car was being used by the husband, although its registration was still in the wifeโs name. The petitioner argued that the dispute was connected to strained family relations and should not be treated as a criminal matter at this stage.
He also informed the court that his wife had already approached a family court for the recovery of dowry items. The same vehicle had been included in those family court proceedings.
Court Notes Pending Family Dispute
Justice Bajwa observed that the complainant had described the car as a dowry item before the family court. However, she did not mention the pending civil proceedings in the FIR lodged against her husband.
The court noted that the matter appeared to arise from a matrimonial dispute rather than clear evidence of criminal intent. It also observed that the accused had joined the investigation and cooperated with the authorities.
The order stated that there was no material on record at this stage to prove dishonest intention on the part of the petitioner. The judge also noted that the vehicle still remained registered in the wifeโs name.
Since the dispute over the vehicle was already part of family court proceedings, the High Court found grounds to grant interim bail.
Bail Granted in Dowry Car Case
The case highlights how family disputes can sometimes lead to parallel civil and criminal proceedings. In this matter, the court gave importance to the fact that the car was already included in the wifeโs dowry recovery claim.
The court also considered the petitionerโs cooperation with the investigation while deciding the bail plea. Interim bail does not mean the case has ended. The investigation and related legal proceedings may continue according to law.
However, the courtโs observations suggest that the dispute may need further examination to determine whether it is a criminal fraud case or mainly a family property dispute.
The Lahore High Courtโs order gives temporary protection to the accused while the matter proceeds further. The final outcome will depend on the evidence, investigation record, and proceedings before the relevant courts.
