The Pakistan Telecommunication Authority (PTA) has raised alarms over the potential risks of launching 5G services in the country amid ongoing legal disputes involving the 140 MHz spectrum. PTA Chairman made the remarks during a meeting of the National Assembly Standing Committee on IT’s Sub-Committee, chaired by Barrister Gohar.
The chairman cautioned that moving forward with the 5G auction while court cases remain unresolved could have serious repercussions. “Until the 140 MHz spectrum is cleared by the courts, proceeding with the 5G auction remains a risky proposition,” he told lawmakers.
He further explained that telecom operators are also hesitant, given the legal uncertainty, which could deter investment and slow down Pakistan’s digital progress.
However, the PTA’s cautious stance faced pushback. A legal representative from the Ministry of IT argued that there is currently no stay order on the spectrum, making the auction legally permissible. Barrister Gohar echoed this view, stating, “The litigation will continue, but when the 5G frequency is already under PTA’s control, there is no legal barrier to going ahead with the auction.”
The meeting highlighted a growing rift between regulatory prudence and political urgency. Barrister Gohar stressed the importance of rolling out 5G technology, particularly in underdeveloped areas. “We urgently need 5G in tribal regions, yet we’re getting caught up in legal complexities. The auction must proceed,” he asserted.
It was also disclosed during the session that several telecom companies are reluctant to participate in the 5G auction until the legal disputes are resolved. Even without a formal stay order, the PTA chairman warned that any operator could potentially seek a court injunction, halting the entire process.
Committee member Sharmila Faruqui questioned the basis of the PTA’s concerns, asking whether they stem from actual legal barriers or merely institutional caution. “Is your hesitation grounded in legal reality, or is it just fear of potential complications?” she inquired.
To address these concerns, the sub-committee decided to summon telecom operators in the next meeting to gather their perspectives. Additionally, the committee agreed to review all relevant court decisions before determining a final timeline for the auction.
The PTA chairman concluded by noting that he has personally appealed to the Prime Minister for swift resolution of the legal cases tied to 5G, underscoring the urgency of clearing the path for next-generation connectivity in Pakistan.
