Curative Review
ISLAMABAD: Chief Justice Umar Ata Bandial of the Supreme Court of Pakistan allowed the government’s plea for withdrawing its curative review petition in the case of Justice Qazi Faez Isa and subsequently dismissed the review petition.
On Friday, the federal government withdrew the curative review against Justice Qazi Faez Isa. Justice Isa is a Senior Supreme Court Justice and the upcoming Chief Justice of Pakistan.
The Supreme Court of Pakistan, in a 13-page verdict, accepted the government’s withdrawal plea.

The verdict stated, “The appellants’ instant Civil Misc. Applications are accordingly allowed, and their curative review petitions are dismissed as withdrawn.”

Meanwhile, Chief Justice said the trial of individuals involved in the May 9 violence should not commence in military courts without informing the Supreme Court.
CJP Bandial, heading a six-member bench that includes Justice Ijazul Ahsan, Justice Munib Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi, and Justice Ayesha A. Malik, resumed hearing a series of pleas challenging the military trials of civilians.
During the hearing, Latif Khosa, the lawyer representing petitioner Aitzaz Ahsan, pointed out that the current situation in the country resembled events that occurred during the tenure of former military dictator Ziaul Haq.
CJP Bandial responded, “You cannot equate the present era with the era of Ziaul Haq. This is not Ziaul Haq’s era, nor is martial law imposed in the country. Even if a martial law-like situation arises, we will intervene.”
In today’s hearing, it appeared that Chief Justice Umar Ata Bandial will not allow the trial of PTI’s leaders and supporters involved in the May 9 attacks, in the military courts.
Hence, it is believed that the matter of the trial of the accused of the May 9 violence will be settled when Justice Qazi Faez Isa becomes chief justice of Pakistan in Sept this year.
