Court issues notice to Tibb Council after practitioner challenges cancellation order, alleging authorities denied him opportunity for hearing
ISLAMABAD: The Islamabad High Court (IHC) on Tuesday suspended the Tibb Council’s decision to cancel the registration of renowned practitioner Hakim Shahzad, allowing the registration to remain effective until the court holds its next hearing.
Justice Muhammad Asif heard the petition filed by Hakim Shahzad challenging the council’s action against him. Advocate Sher Afzal Marwat appeared before the court on behalf of the petitioner and presented arguments against the cancellation order.
During the proceedings, Marwat maintained that the Tibb Council had cancelled his client’s registration as a practitioner without providing him an adequate opportunity to explain his position or defend himself before the relevant authority.
Petitioner Challenges Council’s Cancellation Procedure
The petitioner’s counsel argued that the council’s decision violated the principles of due process because authorities took action without first hearing Hakim Shahzad.
Consequently, the lawyer requested the Islamabad High Court to set aside the council’s decision and declare the cancellation order null and void.
He maintained that authorities should have followed the required legal procedure before taking an action that directly affected the petitioner’s professional registration and ability to practise.
The court considered the preliminary arguments and decided to seek a formal response from the Tibb Council before proceeding further with the case.
Court Seeks Tibb Council’s Response
Meanwhile, Justice Asif issued a notice to the Tibb Council and directed it to submit its response regarding the allegations and circumstances surrounding the cancellation of Hakim Shahzad’s registration.
Importantly, the court provided interim relief to the petitioner by suspending the council’s cancellation order until the next hearing.
The suspension means the disputed decision will remain temporarily ineffective while the court examines the legal arguments and the council’s response.
The Islamabad High Court subsequently adjourned further proceedings in the petition.
The court will consider the Tibb Council’s reply and arguments from both sides when it resumes hearing the case.
