The Supreme Court has postponed the hearing of the Imran Khan hospital transfer case for three weeks. The development follows a new jurisdictional issue involving the Federal Constitutional Court.
The apex court resumed proceedings on Wednesday. However, the hearing could not proceed as planned after the bench learned about petitions filed following its earlier interim order.
Why Did the Supreme Court Delay the Hearing?
The Supreme Court said it had issued an interim order during the previous hearing. However, proceedings faced a new complication before Wednesday’s hearing could begin.
“And before the hearing could start today, the court was told that some petitions had been filed following that order.”
The judges were informed that some cases from the Islamabad High Court had reached the Federal Constitutional Court. Those cases reportedly seek similar relief for former prime minister and PTI founder Imran Khan.
The Supreme Court noted that the Federal Constitutional Court had sought records of cases pending before the apex court before proceeding further.
Federal Constitutional Court Seeks Case Records
The Federal Constitutional Court recently summoned records concerning Imran Khan’s proposed transfer to Shifa International Hospital.
The move came while the FCC was considering cases involving other Adiala Jail inmates seeking similar relief. The court also sought records concerning related matters from the high courts.
As a result, the Supreme Court now faces questions about how the proceedings should continue amid the FCC’s intervention.
The Supreme Court therefore sought assistance from the Attorney General for Pakistan (AGP) regarding the matter.
Justice Shahid Waheed Raises Coordination Concerns
During Wednesday’s hearing, Justice Shahid Waheed questioned the situation surrounding the court orders and subsequent proceedings.
Justice Waheed remarked that the Supreme Court’s order had been violated.
“There is a great lack of trust and coordination,” he added.
The remarks came as the bench considered the implications of the Federal Constitutional Court’s order seeking records of the proceedings.
Hearing Deferred for Three Weeks
With the new legal development before the court, the Supreme Court decided to defer the hearing for three weeks.
The delay comes amid continuing proceedings concerning Imran Khan’s medical treatment and his proposed transfer to a hospital.
For now, the court has sought assistance from the AGP before moving ahead with the matter. The next hearing is expected to address the legal issues that emerged following the Federal Constitutional Court’s intervention.
