Pakistan Tehreek-e-Insaf (PTI) Chairman Barrister Gohar Ali Khan has challenged the imposition of an emergency and Governor’s Rule in Khyber Pakhtunkhwa before the Peshawar High Court. The petition contests the measures introduced after the federal government moved to assume greater control over provincial affairs.
Barrister Gohar filed the petition through Advocate Ali Zaman, challenging the constitutional steps taken following the emergency declaration. The case brings the legal basis of the federal intervention into question as the province faces security concerns.
Why Was an Emergency Declared in Khyber Pakhtunkhwa?
The emergency was declared after the president signed the relevant summary, according to the reported account. The federal government subsequently issued a gazette notification under Article 232 of the Constitution.
The notification followed concerns about rising terrorist attacks and worsening law and order in the province. An official statement said attacks targeting government installations, critical infrastructure and law enforcement agencies had increased.
Furthermore, the statement alleged that the provincial government had failed to demonstrate sufficient resolve or introduce effective measures against terrorism and lawlessness. These claims formed part of the stated justification for the federal government’s decision.
What Powers Does the Governor’s Rule Notification Provide?
Under the notification, the governor may exercise provincial government functions assigned by the federal government. The federal government may also direct the governor to take control of all or selected provincial affairs.
The notification additionally addresses the legislative powers of the Khyber Pakhtunkhwa Assembly. It states that Parliament, or an authority acting under its direction, will exercise those powers.
These provisions outline the changes to provincial governance under the emergency framework. However, Barrister Gohar’s petition challenges the measures introduced under that framework before the Peshawar High Court.
Legal Challenge Puts Federal Intervention Under Scrutiny
The petition seeks to contest the emergency and Governor’s Rule imposed in Khyber Pakhtunkhwa. Its filing brings the dispute over the federal government’s actions before the provincial high court.
The case centres on measures taken under Article 232 and the resulting transfer of provincial government functions. Further proceedings will determine how the court addresses the challenge to the emergency measures.
