The Lahore High Court (LHC) has disposed of a petition challenging the detention of Noreen Niazi and Dr Uzma Khan, sisters of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.
The petition challenged their detention under the Maintenance of Public Order (MPO) Ordinance, which allows authorities to order preventive detention under specified circumstances. The case emerged amid heightened political tensions following the arrests of Imran Khan’s sisters ahead of planned PTI protests.
Detention Orders Challenged in Court
The Lahore administration had ordered Noreen and Uzma’s detention for 30 days under Section 3 of the MPO Ordinance. The authorities cited concerns relating to public safety and the maintenance of public order.
The sisters challenged the detention orders, arguing that the measures were unlawful and that the required legal procedures had not been followed. Their petitions sought judicial intervention against the decisions.
The court had previously declined to suspend the detention notifications immediately and issued notices to the Punjab government and other respondents, seeking their responses.
Court Orders Review of Detention Appeals
In its ruling, Justice Abher Gul Khan directed the competent authority to immediately decide the pending appeal under Section 3 of the MPO Ordinance in accordance with the law.
The court stressed that the authority must make an independent decision while considering constitutional rights and fundamental guarantees. The ruling requires officials to assess the matter lawfully rather than rely solely on the existing detention orders.
The petition was filed by Sakina Niazi, Noreen’s daughter, challenging the detention of her mother and aunt. Additional Advocate General Nasir Chauhan and other representatives appeared on behalf of the Punjab government.
The court also directed prison authorities to ensure that Noreen and Uzma receive all necessary medicines, including life-saving medication. Furthermore, officials must arrange meetings with their families in accordance with prison rules and regulations.
