The Lahore High Court (LHC) has clarified when default tax surcharge becomes applicable, rejecting the Punjab Revenue Authority’s (PRA) calculation method. The court ruled that the surcharge should apply from the 16th day after the tax payment deadline.
The decision came in a petition filed by Al-Rehman Hospitality. It also directed the recalculation of a disputed default surcharge worth Rs2.486 million.
LHC Orders Recalculation of Rs2.486 Million Tax Dispute
In its 13-page written judgment, a two-member bench comprising Justice Abid Aziz Sheikh and Justice Manwar Iqbal Dogal addressed the dispute over surcharge calculations.
The bench held that tax laws must follow their plain and ordinary meaning. Moreover, any uncertainty in tax legislation should be interpreted in favour of the taxpayer.
The court also observed that subordinate rules cannot override the law. Therefore, authorities must calculate default surcharge according to the governing legal provisions.
The judges further clarified that the payment date itself must not count towards the surcharge calculation.
When Does Default Tax Surcharge Begin?
The LHC ruled that default surcharge becomes applicable from the 16th day after the payment due date. Consequently, the PRA must recalculate the disputed amount in line with the court’s interpretation.
The bench remanded the Rs2.486 million case for fresh calculation under the law. It also observed that Rule 11(2) specifies the payment date.
The ruling clarifies the calculation method. However, it does not remove taxpayers’ responsibility to meet tax deadlines.
Taxpayers Must Still Pay Taxes on Time
The court emphasized that delayed payment can still make a taxpayer a defaulter. Therefore, the judgment should not be treated as an exemption from timely tax payments.
The decision establishes an important clarification for calculating default surcharge. It also reinforces the principle that tax authorities must apply the law’s wording when determining financial liabilities.
For taxpayers disputing surcharge calculations, the ruling highlights the importance of the applicable payment deadline and calculation rules.
