ISLAMABAD: A six-member constitutional bench of Pakistan’s Supreme Court has dismissed a review petition challenging the appointment of former Chief Justice Qazi Faez Isa as Chief Justice of the Balochistan High Court. The bench, led by Justice Aminuddin, heard arguments on Thursday.
During the proceedings, Justice Jamal Mandokhail emphasized that the petition was a review and could not be used to reopen the case. The petitioner’s lawyer, Riaz Hanif, argued that the court had revisited cases in the past, citing the Bhutto case, which was revisited after 40 years.
Justice Musarrat Hilali cautioned against using the court as a platform for political statements, affirming that the bench would adhere strictly to legal principles. Justice Muhammad Ali Mazhar reminded the lawyer to maintain decorum and to heed the court’s questions.
Justice Aminuddin asked why the lawyer was avoiding the court’s inquiries, and Justice Mandokhail directly questioned if he intended to reopen the matter. Hanif responded by saying he was presenting facts, noting a lack of records but suggesting they could be obtained from Balochistan.
Justice Aminuddin also questioned the legal grounds for mandatory consultation with the Chief Minister. Justice Hilali urged the lawyer to avoid personal attacks, observing that the case seemed more politically motivated than legally grounded.
Justice Jamal Mandokhail mentioned he would recommend referring the matter to the Pakistan Bar Council. Ultimately, the bench dismissed Riaz Hanif’s review petition, concluding the legal challenge to Justice Isa’s appointment.
