Khyber Pakhtunkhwa Governor Faisal Karim Kundi has authorised deputy commissioners across the province to arrest and detain individuals under Section 3(1) of the Maintenance of Public Order (MPO) Ordinance, 1960. The decision comes amid security concerns and aims to strengthen preventive action at the district level.
According to an official notification, deputy commissioners can exercise these powers after receiving a case from the relevant district police officer (DPO). The measure seeks to speed up administrative decisions and reduce delays when authorities consider preventive action necessary.
Why Has KP Expanded Deputy Commissioners’ Powers?
The decision aims to help district administrations respond more quickly to potential public order concerns. By delegating the authority to deputy commissioners, the provincial administration intends to streamline coordination between district officials and law enforcement agencies.
Previously, administrative delays could affect the timely handling of cases requiring preventive measures. Under the new arrangement, deputy commissioners will be able to act upon cases referred by their respective DPOs, in accordance with the notification.
However, the governor has directed all deputy commissioners to exercise their powers within the framework of the Constitution and applicable laws. He has also stressed the importance of coordination with law enforcement agencies.
Governor Warns Against Misuse of Authority
While authorising the expanded powers, Kundi cautioned deputy commissioners against any misuse of their authority. His directions emphasise that officials must follow legal requirements when making decisions involving arrest and detention.
The governor said public peace, security and safety remained his top priorities. Consequently, the measure seeks to strengthen preventive administration while maintaining compliance with constitutional and legal safeguards.
The MPO Ordinance, 1960, provides the legal framework cited in the notification for the delegated powers. Authorities are expected to apply the provisions in line with the relevant law and official instructions.
KP Governor Pledges Support Against Terrorism
Earlier, while speaking to the media in Peshawar, Kundi reaffirmed his support for police and security forces fighting terrorism. He said the provincial authorities would provide them with full support in their efforts to address security threats.
The delegation of powers comes as the provincial administration focuses on public safety and preventive measures. Meanwhile, deputy commissioners will be responsible for exercising the newly delegated authority within their respective districts.
The effectiveness of the arrangement will depend on lawful implementation, timely coordination and responsible use of the powers granted under the notification.
