The Islamabad High Court (IHC) has imposed a complete ban on all types of shisha cafes in the federal capital. The court also cancelled previously issued permits, ordering authorities to enforce the restrictions immediately.
Chief Justice Sarfaraz Dogar issued the 19-page written judgment on Wednesday. The ruling will remain effective until the government introduces proper rules for operating shisha cafes.
Islamabad High Court Cancels Shisha Cafe Permits
According to the verdict, all shisha cafes must stop operating, including businesses holding No Objection Certificates (NOCs).
The court declared that previously issued permits no longer provide legal protection.
It also clarified that official permission cannot make an otherwise prohibited activity lawful without proper regulations.
The judgment directs government law officers to finalize the required rules without unnecessary delays.
Authorities Ordered to Enforce Complete Ban
The court instructed Islamabad’s Chief Commissioner, Deputy Commissioner, and Inspector General of Police to implement the decision.
It also ordered relevant departments to receive copies of the judgment.
The ruling highlights public health concerns linked to smoking establishments.
Furthermore, the court referred to World Health Organization guidelines while examining potential health risks.
Court Highlights Earlier Orders
The judgment noted that authorities had failed to implement a previous Islamabad High Court order issued in 2022.
It also referred to Supreme Court directions from 2016 concerning shisha cafes across Pakistan.
The court stressed that businesses must follow established laws and public health regulations.
Meanwhile, the IHC disposed of the related petitions after issuing its directions.
The decision means shisha cafes across Islamabad cannot resume operations until authorities establish the required legal framework.
