The International Court of Justice (ICJ) has called upon Israel to promptly and effectively execute the provisional measures it mandated last month to prevent genocide in the besieged Gaza Strip.
In a press release issued on Friday in response to a request from South Africa for additional measures, the Court expressed deep concern over the recent developments in the Gaza Strip, particularly in Rafah.
It emphasized the urgent need to address the escalating humanitarian crisis with potentially severe regional repercussions, echoing the sentiments of the United Nations Secretary-General.
The Court underscored the critical nature of the situation in Gaza and Rafah, the southernmost city in the blockaded territory, stressing the immediate and effective implementation of the provisional measures outlined in its January 26, 2024 Order.
However, the Court clarified that while the situation demands urgent action, it does not necessitate the introduction of further provisional measures. It reiterated that Israel is obligated to fully comply with its responsibilities under the Genocide Convention and the aforementioned order, which includes ensuring the safety and security of Palestinians in Gaza.
South Africa initiated the genocide case against Israel in late December, urging the ICJ to impose emergency measures to halt the violence in the besieged Gaza Strip, where the death toll has surpassed 28,775 Palestinians since October 7.
On January 26, the Court ruled that Israel must take all necessary measures to prevent acts of genocide in Gaza and to facilitate the immediate and effective delivery of essential services and humanitarian aid in the blockaded enclave. However, it stopped short of mandating a ceasefire.
Despite widespread international condemnation, Israel has announced plans for a ground invasion of Rafah, home to approximately 1.4 million refugees. Israeli Prime Minister Benjamin Netanyahu has vowed to pursue the campaign until achieving complete victory, including through significant action in Rafah.
