Intra-Party Polls Case
The Election Commission of Pakistan (ECP) has recently dismissed all four miscellaneous pleas filed by the Pakistan Tehreek-e-Insaaf (PTI) regarding the ongoing intra-party elections case.
The decisions were made after careful consideration of the issues raised by PTI, which sought various adjustments in the handling of the intra-party electoral process.
One of the key pleas rejected by the ECP was PTI’s objection to the commission’s jurisdiction over intra-party elections. PTI had challenged the ECP’s authority to oversee and adjudicate matters related to their internal elections.
However, the ECP maintained that it has the mandate and jurisdiction to address and resolve issues concerning intra-party electoral procedures under the applicable laws.
Additionally, PTI’s request for an adjournment of the intra-party election case was also turned down. The party had sought a postponement, arguing that additional time was needed to address certain concerns and to gather necessary documentation.
The ECP, however, decided against granting this delay, emphasizing the need for timely resolution of electoral disputes to ensure the integrity and transparency of the electoral process.
The ECP also rejected PTI’s plea to postpone intra-party elections for specific seats until a final decision was made on the matter. This request aimed to delay the elections in certain constituencies until the commission had made a ruling on the broader issues at hand.
The ECP’s decision reflects its commitment to adhering to the electoral timeline and ensuring that elections proceed as scheduled unless otherwise warranted by law.
Furthermore, the ECP directed PTI to approach the Federal Investigation Agency (FIA) to seek the return of documents that were taken from the party’s office.
This instruction underscores the commission’s role in ensuring that all relevant documentation is properly accounted for and returned as part of the investigation process.
In its decision, the ECP reaffirmed its responsibility under Section 208 of the Election Act, 2017, which mandates the commission to review and enforce the legal requirements for intra-party elections.
The commission’s role includes verifying the issuance of the certificate as outlined in Section 209-3, ensuring that all procedural and legal standards are met.
The ECP’s written decision, which spans ten pages, was authored by Nisar Durrani, a member of the ECP from Sindh.
This detailed ruling provides a comprehensive overview of the ECP’s stance on the issues raised by PTI and reinforces the commission’s role in overseeing and regulating the electoral process within political parties.
