ISLAMABAD: The Supreme Court adjourned the hearing of the case against the ruling of the National Assembly speaker about dismissal of no-trust move till Tuesday.
A five-member larger bench of the Supreme Court headed by Chief Justice Umar Ata Bandial was hearing the case. Justice Muneeb Akhtar, Justice Ijaz ul Ahsan, Justice Jamal Mandokhel, Justice Mazhar Alam Miankhel were the part of the bench.
During the hearing on Monday, chief justice said that the court has to see the constitutional status of whatever had happened in the assembly.
Earlier, the chief justice said that it will issue an order today, but the hearing was adjourned till tomorrow (April 5/12:00 Noon).
CJP Bandial dismissed PPP’s request form a full-bench to hear this case and said that if you have any objection on the bench, we can leave. Constituting a full bench impact the hearing of other cases, he said. Even last year, 10,000 pending cases were increased due to full court, he added.
Farooq Naik, who is representing PPP, said full court used to be constituted on sensitive matters.
A three-member bench issued an order Sunday over the “constitutional situation” following the speaker’s ruling to disallow the no-confidence motion against Prime Minister Imran Khan, who shortly after the speaker’s ruling advised the president to dissolve the National Assembly.
The top court has ordered that any order of the president and prime minister will be subject to a final verdict of the Supreme Court.
The apex court has also questioned the justification for the speaker’s ruling when there were no findings on the claims about foreign conspiracy.
The speaker on Sunday based his ruling on the claim that the no-confidence motion was “apparently” linked to a foreign conspiracy to topple an elected government in Pakistan.
However, the court has not suspended the speaker’s ruling.
The chief justice also said that the Supreme Court could rule over the National Assembly proceedings up to a certain extent.
The Supreme Court has announced that it is forming a larger bench on the issue, which will hear the the suo moto notice and the petitions file by various parties at 1pm on Monday.
PPP lawyer Latif Khosa had petitioned the court to suspend the speaker’s ruling and grant an interim relief while opposition parties also filed a joint petition.
Supreme Court Bar Association (SCBA), too, filed a petition over the speaker’s ruling and the president’s order to dissolve the National Assembly.
Before the petitions were filed, CJP Bandial took suo moto notice over the situation that developed following the speaker’s ruling.
