The Peshawar High Court (PHC) has halted the deportation of Afghan students enrolled in medical and dental colleges across Khyber Pakhtunkhwa. The court also directed the students to continue their education while proceedings in the case remain pending.
A two-member bench comprising Justice Waqar Ahmad and Justice Farah Jamshed heard petitions filed by 14 Afghan students, including Inayatullah Momand and Hilal Shahzad. The court issued notices to the relevant respondents and sought their replies within 14 days.
Court Seeks Replies From Relevant Authorities
During the hearing, Advocate Waseem-ud-Din Khattak told the court that the students secured admission to medical and dental colleges through the prescribed legal process under the Afghan quota. He added that the Higher Education Commission had issued No Objection Certificates to facilitate their visa applications.
However, the Pakistan Medical and Dental Council later issued notices on July 31 and September 1. According to the petitioners, the notices cancelled the students’ admissions and directed them to return to Afghanistan.
Students Allowed To Continue Education
The petitioners’ legal team included Advocate Waseem-ud-Din Khattak, while Assistant Attorney General Ishaq Khalil and NADRA Law Officer Muhammad Mubarak Jan also appeared before the court. Following the hearing, the PHC allowed the Afghan students to continue their studies until further proceedings.
The court adjourned the case until October 12. Further developments will depend on the responses submitted by the concerned authorities.
