SC Constitutional Benches Set to Begin Hearings from November 14

Constitutional Benches

ISLAMABAD: The Supreme Court (SC) of Pakistan’s constitutional benches are set to commence hearing cases starting on Thursday, November 14.

This decision was reached during a meeting of a seven-member constitutional bench formed by the Judicial Commission of Pakistan (JCP).

Justice Aminuddin Khan, a senior Supreme Court judge, chaired the meeting. Justice Muhammad Ali Mazhar participated virtually, as per the sources.

The meeting, which lasted for approximately one hour, resulted in the decision to begin hearing cases before the constitutional benches from the set date of November 14.

Chief Justice of Pakistan (CJP) Yahya Afridi led the JCP in appointing Justice Aminuddin Khan as the head of the newly formed constitutional bench. This decision was made by a majority vote of 7-5 members.

The bench consists of seven members, including Justice Aminuddin Khan from Punjab, Justice Ayesha Malik from Punjab, Justice Naeem Akhtar Afghan and Justice Jamal Khan Mandokhel from Balochistan, Justice Muhammad Ali Mazhar and Justice Hasan Azhar Rizvi from Sindh, and Justice Musarrat Hilali from Khyber Pakhtunkhwa.

Although the decision to form the constitutional bench was passed by a majority, it did not go uncontested. Chief Justice Yahya Afridi, along with Justice Mansoor Ali Shah, Justice Munib Akhtar, and PTI members Omar Ayub and Shibli Faraz, opposed the formation of the bench.

However, the majority of votes in favor overruled the opposition, leading to the establishment of the bench.

The meeting of the Judicial Commission of Pakistan was attended by prominent figures, including senior Puisne Judge Justice Syed Mansoor Ali Shah, Justice Munib Akhtar, and Justice Aminuddin Khan.

Also in attendance were Federal Law Minister Azam Nazir Tarar, Attorney General Mansoor Usman Awan, and Pakistan Bar Council’s representative Advocate Akhtar Hussain.

Members of political parties were also present, including Farooq H. Naik of the Pakistan People’s Party, PML-N’s Sheikh Aftab Ahmed, and Roshan Khurshid Barrucha.

This upcoming session of constitutional case hearings marks a significant step forward for the SC, as it begins its work under the leadership of the newly appointed bench.

The development reflects the internal dynamics of the Judicial Commission and its efforts to ensure constitutional cases are addressed efficiently by a well-structured judicial panel.
