ISLAMABAD: The Supreme Court said on Tuesday that it would guarantee that no institution exceeded its boundaries and that it did not want to deliver an order that would be “uncomfortable” for the government.
As Pakistan’s Attorney General Ashtar Ausaf could not appear before a notable bench of five justices, the Additional Attorney General (AAG) represented him.
A five-member bench, led by Chief Justice of Pakistan Justice Umar Ata Bandial, heard a suo motu case about the alleged interference in the prosecution and investigation in high-profile cases,
30 persons have left the country after being removed from the Exit Control List (ECL), according to the additional attorney general.
Justice Ijazul Ahsan inquired if the federal cabinet had allowed these modifications to the ECL regulations.
The additional attorney general stated that the issue was now being discussed in the cabinet committee on legislation.
However, Akhtar emphasised that judges might comprehend that the government had simply accused these persons, but that the bench needed to know why.
The CJP pointed out, anyone who needed to leave the nation for official reasons should be permitted to do so.
Anyone on the list who wants to travel outside of Russia must first acquire authorisation from the Interior Ministry.
“The present state of affairs in the nation is quite exceptional.”
“There is an economic catastrophe in our nation because of the departure of a major party from the assembly.”
In order for the system to function, Justice Bandial emphasised the need for collaboration among all parties.
A “unilateral” parliament’s lawmaking must also comply with the law.
“This is not a chance for anybody to exploit. To ensure that no institution exceeds its bounds.” Justice Munib said that the government’s stated goals and objectives baffled him. “It seems like the administration is on shaky ground.”
Additionally, he said the government should tell the court on the ECL legislation’s legal foundation.
Justice Ahsan questioned why the names had to be removed from the ECL in such a short time.
In response, a second attorney general said that the ECL included the names of cabinet members.
“In the past, names have been removed from the ECL in the same way,” he said.
Justice Sayyed Mazahar Ali Akbar Naqvi questioned him if it occurred in the past, would it happen in the future as well?
The CJP remarked that there would be no compromise over the legal process and if anyone thought that the case had no relevance, they should approach the relevant court.
The Chief Justice of Pakistan (CJP) also praised Prime Minister Shehbaz Sharif’s decision to petition the Supreme Court for bail personally during the hearing.
“It felt nice when the prime minister and the chief minister of [Punjab] attended in person and were given bail.”
According to the extra attorney general, a formal protocol on the regulations will be developed in the coming days. In addition, he appeared on the dais and told the court that he was in contact with the investigative authorities in order to get the revisions and names removed off the ECL, which he did.
In addition, he said that the suspects could not travel outside of the country unless given special authorisation in advance. Under the new guidelines, a suspect may only travel outside of the country with the permission of the relevant organisations.
