PTA Proposes Licensing Framework for Streaming Platforms Like Netflix and YouTube

ISLAMABAD: The Pakistan Telecommunication Authority (PTA) has unveiled a proposed regulatory framework for Over-The-Top (OTT) services, which encompass widely used applications like WhatsApp, Zoom, Facebook, YouTube, and Netflix. The draft framework, now available on the PTA’s website, is open for public comment over the next two weeks.

The proposed framework categorizes OTT services into three distinct groups: OTT Communication Services (OCS), which include real-time communication services such as WhatsApp, Skype, and Zoom that utilize the internet instead of traditional phone lines; OTT Application Services (OAS), which cover applications that don’t replace traditional telecom services, such as social networking, e-commerce, e-health, e-education, and navigation apps like Google Maps; and OTT Media Services (OMS), which involve audio and video streaming services.

OMS are further divided into Broadcasting OTT Media Services, regulated by the Pakistan Electronic Media Regulatory Authority (PEMRA), including services like PTV and ARY NEWS, and Non-Broadcasting OTT Media Services, which include platforms such as YouTube, Netflix, and Spotify.

The PTA will be responsible for registering and authorizing most OTT services, while the PEMRA will oversee broadcasting media services. The framework also outlines procedures for content monitoring and removal, involving the PTA and other government bodies. A significant feature of the proposal is the introduction of a 15-year license for OTT service providers operating in Pakistan. Telecom Service Providers (TSPs) offering OTT communication services will need PTA authorization, whereas other OTT providers can directly apply for a license.

This regulatory framework aims to create a supportive environment for the growth and management of OTT services in Pakistan. By establishing clear guidelines and responsibilities for service providers, the PTA seeks to ensure a balanced approach that promotes innovation while maintaining regulatory oversight.

The PTA encourages stakeholders and the public to review the draft and submit their comments within the specified two-week period, ensuring that the final regulations reflect a comprehensive understanding of the industry’s needs and challenges.
