Pakistan Bar Council Urges Specialized Court for Political Cases

The Pakistan Bar Council has taken significant steps to address judicial efficiency and the handling of political and constitutional cases within the country’s judiciary.

In a recent statement, the Council disclosed that it had formally requested Chief Justice Qazi Faez Isa to appoint ad hoc judges to the Supreme Court.

This initiative aims to streamline the judicial process and expedite the resolution of pending cases, particularly those of political and constitutional nature.

Chief Justice Qazi Faez Isa promptly responded to this request by convening a meeting of the Judicial Commission of Pakistan on July 19th.

This meeting is set to discuss the appointment of ad hoc judges, a practice permitted under the constitutional framework to alleviate the burden on the judiciary and enhance case management efficiency.

The statement released by the Pakistan Bar Council commended the temporary appointment of retired judges to the Supreme Court, emphasizing its constitutional validity and potential to establish permanent benches in the Supreme Court registries.

This strategic move is anticipated to bolster the judicial system’s capacity to handle a broader spectrum of cases more expeditiously.

Furthermore, the Council urged the federal government to consider amending the Constitution to establish a dedicated Constitutional Court.

Such a court would specialize in adjudicating constitutional and political cases exclusively, thereby freeing up the Supreme Court’s resources.

This restructuring is envisioned to prioritize the resolution of cases affecting ordinary citizens, which have often been delayed due to the backlog of politically sensitive cases.

The proposal underscores the Council’s belief that separating political and constitutional matters into a distinct court would allow the Supreme Court judges to focus more attentively on non-political cases.

This strategic realignment aims to restore public confidence in the judiciary by ensuring prompt justice delivery and reducing case backlogs.

In related developments, Barrister Gohar, Chairman of the Pakistan Tehreek-e-Insaf (PTI), has announced intentions to engage the Supreme Judicial Council regarding the appointment of ad hoc judges.

His stance contrasts with previous criticisms of appointing ad hoc judges during court vacations, which he deemed detrimental.

Chief Justice Qazi Faez Isa’s proactive approach in convening the Judicial Commission meeting signifies a pivotal step towards judicial reform and enhancing the judiciary’s operational efficiency.
