ISLAMABAD: The Pakistan Bar Council (PBC) vehemently denounced the Pakistan Tehreek e Insaf (PTI) on Monday for its “unwarranted” demand for Chief Justice Qazi Faez Isa to recuse himself from all cases involving the party.
PBC Vice Chairman Riazat Ali Sahar and Executive Committee Chairman Farooq Hamid Naek strongly condemned PTI’s demand, asserting that it was against the spirit of judicial independence. They emphasized that such demands amounted to unwarranted interference in the judiciary’s affairs and undermined the principle of separation of powers.
PTI spokesperson Raoof Hasan expressed these concerns during a televised interview, highlighting the party’s perception of bias in the judicial process. He argued that PTI’s petitions were not being given due consideration and called for Chief Justice Isa to step back from cases involving the party.
The PBC rebuffed PTI’s assertions, citing the Supreme Court Practice and Procedure Act, 2023, which vests bench formation authority in a committee of three members, including the chief justice and the two most senior judges. Therefore, PTI’s demand was deemed unnecessary and contrary to established legal norms.
Sahar and Naek criticized PTI’s attempt to exert pressure on the judiciary, characterizing such tactics as deplorable and detrimental to the rule of law. They reaffirmed their commitment to upholding the independence and integrity of the judiciary, stressing the importance of respecting judicial decisions and processes.
They commended Chief Justice Isa’s integrity, competence, and impartiality, emphasizing his unwavering dedication to upholding the principles of justice and fairness.
