Plaintiff Claims No Valid Marriage Took Place
A woman from Lahore’s Kahna area has challenged her daughter’s alleged oral marriage before a family court.
The petitioner, Bilqis Bibi, claimed that no formal marriage ceremony was conducted.
She alleged that the man had deceived her daughter and falsely presented the relationship as a valid marriage.
Bilqis asked the court to take legal action against the man.
She argued that an oral claim alone could not establish the marriage without reliable evidence or official documentation.
Defence Presents Four Marriage Witnesses
Advocate Shahbaz Bhatti appeared on behalf of the man and presented four witnesses before the court.
The defence lawyer said no official marriage registrar was present when the ceremony took place.
However, he argued that the marriage was conducted in front of witnesses.
The witnesses told the court that they were present and confirmed that the marriage ceremony had occurred.
The defence maintained that an oral marriage may be considered valid under Islamic law when the required witnesses and conditions are present.
The lawyer said written registration provides a formal record of the marriage.
Such documents usually include the agreed financial settlement, expenses and other conditions between both parties.
He argued that registration supports evidence but does not automatically determine whether the original ceremony occurred.
Court Schedules Further Legal Arguments
The family court heard both sides and reviewed the initial statements of the witnesses.
The central dispute concerns whether the alleged oral ceremony fulfilled the legal and religious requirements of marriage.
The court must also examine the petitioner’s allegation that her daughter was misled.
Lawyers from both sides have been summoned for further arguments on July 26.
The court is expected to review the witnesses’ credibility, the circumstances of the ceremony and the absence of official registration.
