LAHORE/ISLAMABAD: The Lahore High Court has dismissed an appeal by a man convicted of contracting a second marriage without his first wife’s consent. The court upheld a three-month imprisonment and a fine of Rs1 million, reinforcing the importance of adhering to legal requirements before entering into another marriage.
During the proceedings, Chief Justice Aalia Neelum questioned the defense counsel about the grounds for the second marriage. She asked whether the aging of a wife could ever serve as a valid justification. Highlighting the social implications, the judge remarked, “If women also start doing this, what will happen to society?”
The bench made it clear that no reasoning or excuse could override the legal obligation of obtaining prior permission from the first wife. The ruling emphasized that this requirement is fundamental and cannot be disregarded under any circumstances.
According to details shared in court, the convict first married in 1999 and then contracted a second marriage in 2017. His lawyer argued that the man had filed a claim to settle matters with his first wife. However, when the Chief Justice inquired whether the settlement attempt occurred before or after the second marriage, the lawyer failed to provide a clear response.
Sentence Upheld by Court
The Lahore High Court confirmed the lower court’s decision, maintaining the three-month jail term and Rs1 million fine. The bench observed that the defense presented no credible grounds to challenge the punishment.
This ruling reinforces the significance of seeking lawful approval before marrying again. It also sends a strong message that bypassing consent not only violates the law but also disrupts family harmony. Legal experts believe this decision highlights the judiciary’s commitment to protecting women’s rights in marital relationships.
With this judgment, the Lahore High Court has once again underscored that the sanctity of marriage must be respected. Obtaining prior consent is not only a legal requirement but also an ethical responsibility in safeguarding family values.
