IHC Grants Interim Relief to Apartment Owners
The Islamabad High Court has restrained the Capital Development Authority from evicting residents of One Constitution Avenue.
The order provides temporary relief to apartment owners challenging an earlier court decision.
The case was heard by a division bench comprising Justice Muhammad Azam Khan and Justice Inam Amin Minhas.
Prominent Residents Challenge Previous Court Ruling
Several apartment owners filed intra-court appeals against the earlier judgement.
The appellants include former Air Chief Marshal Mujahid Anwar Khan, former ICC president Ehsan Mani, and former Senate chairman Wasim Sajjad.
Lawyers representing the residents argued that third-party property rights were being affected.
Court Questions CDA Over Building Approval and Ownership Rights
During the hearing, the court questioned the CDA about the appointment of an administrator and the protection of residentsโ rights.
The bench also raised concerns over the absence of a completion certificate for the building.
Judges questioned how residents were allowed possession without official approval.
The CDA admitted that the completion certificate had not yet been issued.
Lawyers for the apartment owners argued that the authority had already recognised residentsโ rights and collected lease-related charges.
The court ordered that no apartment owner should be evicted until further proceedings in the case.
