Hollywood actress Halle Berry has suffered a setback in her ongoing custody dispute with former husband Olivier Martinez, as he retains primary physical custody of their 13-year-old son, Maceo.
A Los Angeles judge rejected Berry’s request to restore their previous 50/50 custody arrangement. The ruling also prevents the actress from having overnight visits with her son, although she retains joint legal custody.
However, the court dissolved a temporary domestic violence restraining order previously obtained by Martinez against Berry.
Court Rejects Berry’s Request for Equal Custody
The latest decision followed several days of closed court hearings involving the former couple’s custody dispute.
Martinez had accused Berry of physically abusing their son during an incident on September 26. He alleged that the actress grabbed Maceo by the neck during an argument involving a virtual reality game.
Berry strongly denied the allegations, maintaining that she had never physically or emotionally abused her son. She also described herself as a domestic violence survivor and advocate.
The judge rejected Martinez’s request to make the temporary restraining order permanent. However, the existing custody arrangement will remain in place for now.
Custody Dispute Set for Further Review
Despite losing her request for equal physical custody, Berry retains joint legal custody and reportedly has tie-breaking authority when the former couple disagrees over decisions involving their son.
Meanwhile, the court is expected to reconsider custody arrangements in November. Martinez had also requested restrictions on Berry’s holiday visits, but the judge rejected that request.
Berry and Martinez finalised their divorce in 2023 after years of legal proceedings. They had previously agreed to share custody of Maceo.
