PTI challenges trials in military courts, deployment of the army in the Supreme Court

ISLAMABAD: The Pakistan Tehreek-e-Insaf challenged in the Supreme Court of Pakistan the trials of PTI leaders and supporters in the military courts pertaining to the May 9 violence.

The PTI also challenged the deployment of the armed forces under Article 245, asserting that it was being used for the political victimization of the Imran Khan-led PTI.

PTI argued in its petition that the trial of the civilians accused of May 9 arson under military courts was a “clear violation of due process” and Pakistan’s commitment to international laws.

PTI’s Additional Secretary General Omar Ayub Khan filed the petition on behalf of the party. He sought the court’s intervention under Article 184(3).

The petitioner has raised 22 questions before the apex court asking for its input on the scope of the law, whether the requisition violates Article 17 or not, and if the deployment is a “threat to the system of parliamentary democracy”.

“Whether the trial of civilians through military courts is a clear violation of the Constitutional guarantees of due process and fair trial and violation of Pakistan’s existing obligations under the International Covenant on Civil and Political Rights (ICCPR) as well as the jurisprudence developed by this Honorable Court?” asked the plea.

The petition also seeks the court’s viewpoint about the “federal government’s support” of the public gathering held by the Pakistan Democratic Movement (PDM) outside the Supreme Court. It demonstrated a “discriminatory attitude” towards the use of Article 245 and Section 144.

According to the petitioner, the arrests of PTI leaders, and workers, and labeling them as ‘terrorists’ seems a tactic to delay polls. The PTI has urged the Supreme Court to look into this matter.
