SC Orders Federal Government to Submit Report on Audio Leak Commission

The Supreme Court’s Constitution Bench has instructed the Attorney General to consult with the federal government and report back on the current status of the Audio Leak Commission.

A seven-member bench, led by Justice Aminuddin Khan, raised concerns about the commission’s future, noting that its chairman has retired and another member has been appointed as a Supreme Court judge. Justice Aminuddin questioned the relevance of the commission under these circumstances, prompting the Attorney General to request time to seek clarification from the government on whether a new commission will be formed.

The Attorney General acknowledged that the audio leak case also involves complex legal issues and needed further consultation. Justice Aminuddin remarked that the case might lose its significance if a new commission is established.

Justice Muhammad Ali Mazhar reminded the bench that the cabinet’s decision to form the commission was still valid, while Justice Jamal Khan Mandukhel asked whether the government would consult the Chief Justice before nominating judges for the commission. The Attorney General responded that such consultation is not required by law, but Justice Mandukhel insisted that the court’s authority should not be undermined, raising concerns about the Chief Justice’s role in the judge selection process.

The hearing was adjourned until next week, with the court awaiting the government’s response.
