PESHAWAR: Khyber Pakhtunkhwa Governor Faisal Karim Kundi has submitted his written reply to the Peshawar High Court (PHC) through the Additional Attorney General regarding the resignation of the former chief minister and the oath-taking of the newly elected one.
Governor Commits to Acting Within Constitutional Limits
In his response, Governor Kundi assured the court that he would act strictly in accordance with the Constitution.
He said he would accept the chief minister’s resignation and administer the oath to the new CM as required by law.
The governor stressed that all actions must align with constitutional procedures and democratic norms.
Questions Raised Over Legality of CM Election
Governor Kundi questioned how a new chief minister could be elected before the incumbent’s resignation was formally approved.
He argued that the move reflected a “series of unconstitutional acts” by the provincial government.
The governor emphasized that legal procedures must be completed before initiating any leadership transition in the province.
Supreme Court Judgment Cited for Verification
Governor Kundi also referred to a Supreme Court judgment outlining the process of resignation verification.
He said the authority receiving a resignation must ensure it is genuine and given voluntarily, not under duress.
“If a resignation is submitted under pressure, it could harm democracy,” the governor warned.
PHC Earlier Sought Governor’s Availability
Earlier, the Peshawar High Court had directed the Additional Advocate General to confirm the governor’s availability for administering the oath to the newly elected chief minister.
The court’s directive came amid ongoing confusion over the status of the chief minister’s resignation and the legitimacy of the new appointment.
