Court Orders Arrest Over Repeated Non-Appearance
An Islamabad district and sessions court has issued a non-bailable arrest warrant for Khyber Pakhtunkhwa Chief Minister Sohail Afridi. The warrant was issued on Wednesday after the chief minister repeatedly failed to appear before the court. The case involves allegations of misleading statements made against state institutions.
Senior Civil Judge Abbas Shah issued the arrest order after noting Afridiโs continuous absence from hearings. The court had previously summoned the chief minister several times. Despite these summons, he did not attend the proceedings. The judge ruled that strict action was necessary to ensure compliance with the law.
The court directed law enforcement agencies to arrest CM Afridi and present him before the court. The judge also made it clear that public office holders are not above the law. Further proceedings in the case have been adjourned until February 10.
The decision has drawn significant attention due to Afridiโs position as the sitting chief minister of Khyber Pakhtunkhwa. Legal experts say the case highlights increasing judicial scrutiny of political leaders.
Cybercrime Charges Under PECA Explained
The case against CM Sohail Afridi was registered by the National Cyber Crime Investigation Agency. The charges were filed under the Prevention of Electronic Crimes Act. Authorities allege that Afridi made statements that damaged the reputation of state institutions.
According to the investigation agency, the statements were shared through electronic means. Officials claim the content violated provisions of cybercrime laws. These laws aim to prevent misinformation and protect institutional credibility.
The court took notice of the seriousness of the allegations. It observed that repeated non-appearance obstructed judicial proceedings. The judge emphasized that lawful process must be followed regardless of political status.
The cybercrime case adds to a growing list of legal challenges facing the chief minister. Observers note that PECA cases often carry strict penalties. Legal analysts believe Afridiโs appearance before the court will be crucial for the next phase of the trial.
CM Afridi Faces Multiple Legal Challenges
In addition to the cybercrime case, CM Afridi is also facing proceedings in an anti-terrorism court. These proceedings relate to his alleged role in the November 26 protest held in Islamabad. Authorities claim the protest led to unrest and disruption in the capital.
The chief minister is also under scrutiny by the Election Commission of Pakistan. The ECP initiated proceedings over an alleged violation of the code of conduct during a recent National Assembly by-election in Khyber Pakhtunkhwa. The case involves accusations of threats made to government officials.
A day before the arrest warrant, the Peshawar High Court provided temporary relief to Afridi. The court restrained the ECP from issuing any final order against him in the Haripur by-election case. The order was passed by a two-member bench comprising Justice Syed Arshad Ali and Justice Faheem Wali.
During the hearing, Afridiโs counsel argued that the speech in question was delivered outside the relevant constituency. He stated that the chief minister was on an official tour announcing development projects. Despite this, the ECP issued a notice and initiated proceedings.
The high court summoned the ECP record and briefly adjourned the hearing. Legal proceedings across multiple forums continue to place CM Afridi under intense legal and political pressure.
