LAHORE: Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan has challenged the physical remand granted by an anti-terrorism court in 12 cases.
The petition, filed in the Lahore High Court, argues that the lower court did not thoroughly review the records before granting the physical remand and that the police have already conducted their investigation while Khan was in jail.
The petitioner further claims that the law was not followed during the granting of the physical remand and requests the court to declare the remand null and void in all 12 cases.
Earlier, an Anti-Terrorism Court (ATC) had sent Imran Khan on a 10-day physical remand in connection with 12 cases related to the riots on May 9. Khan was produced via video link due to ‘security concerns,’ as cited by the prosecutor.
The judge, Khalid Arshad, questioned the necessity of not presenting the accused in person. The prosecutor responded that it was for security reasons and that they needed to investigate Khan regarding footage from the May 9 incidents. He added that Khan would remain in Adiala Jail for the investigation.
The defence counsel opposed the physical remand plea, arguing that remand cannot be granted if the accused is presented via video link. Usman Gul, Khan’s lawyer, emphasized that physical remand requires the accused’s appearance in court.
It is pertinent to mention that Imran Khan and his wife, Bushra Bibi, are already on a six-day physical remand in a new Toshakhana case until July 19.
