Amid Constitutional Scrutiny, ECP Provides Clarity on Senate Membership Status

The Election Commission of Pakistan (ECP) addressed concerns raised by Pakistan People’s Party (PPP) Senator Taj Haider on Wednesday, providing clarification on the intricate legalities surrounding the membership of senators elected to other legislative bodies.

The response from the Election Commission referenced Article 223-4 of the Constitution, emphasizing that if a member of one house is elected to another, the original seat becomes vacant.

This clarification has significant implications for senators elected to other bodies, including Sadiq Sanjrani, Yusuf Raza Gilani, Maulana Ghafoor Haidari, Prince Umar Ahmedzai, and Sarfraz Bugti.

Senator Taj Haider, who sought clarification on senators concurrently holding positions in assemblies, expressed concern over potential constitutional violations. He particularly criticized Sadiq Sanjrani for allegedly presiding over Senate meetings after being elected as an MPA, questioning the legal standing of decisions made during this period.

Highlighting the ramifications of the Election Commission’s interpretation, Senator Taj Haider invalidated Sanjrani’s approval of resignations from Sarfaraz Bugti and Prince Umar Ahmedzai. He emphasized the need for clarity on the matter, expressing bewilderment over the Senate Secretariat’s response to the Election Commission’s interpretation.

In response to queries regarding Yusuf Raza Gilani’s candidacy for Senate Chairman, Senator Taj Haider confirmed Gilani’s ousting from the Senate. This development opens the door for a new chairman from within the PPP ranks.

Senator Taj Haider also advocated for Farooq H. Naik as a deserving candidate for the post of Chairman Senate, signaling a potential shift in the leadership dynamics of the upper house.

The ECP’s clarification adds a layer of complexity to the political landscape, prompting further discussions on the legal standing of senators holding dual positions. Overall, ECP clarifies legalities on Senate membership in other bodies, responding to queries by PPP Senator Taj Haider.
