ISLAMABAD: Justice Aminuddin Khan is likely to head the Federal Constitutional Court. Justice Khan is currently heading the Supreme Court’s Constitutional Bench. Justice Aminuddin Khan is expected be appointed as the first Chief Justice of the upcoming Federal Constitutional Court (FCC). After the approval of the 27th Constitutional Amendment Bill from the Parliament, the FCC would be formed as early as possible, according to Dawn.com
Initial Composition and Structure
According to sources, the FCC will initially comprise six other judges besides the Chief Justice. The proposed names include Justices Hasan Azhar Rizvi, Musarrat Hilali, Aamer Farooq, and Baqar Najafi from the Supreme Court, while Justices K.K. Agha and Rozi Khan Barrech are being considered from the high courts. The courtโs strength will initially be fixed through a Presidential Order, while any future expansion will require parliamentary approval.
Appointment and Oath Procedures
It has been learnt that the President will administer the oath to the Chief Justice, who will then swear in the remaining judges. Law ministry officials confirmed that appointments will be made by the President on the prime ministerโs advice under the newly amended constitutional provisions.
Purpose and Location of the FCC
The courtโs creation has been proposed to ease the Supreme Courtโs workload and ensure faster adjudication of constitutional matters. The FCC will operate separately from the Supreme Court and is likely to be housed in the Federal Shariat Court building in Islamabad while Shariat Court judges may be relocated somewhere else.
Moreover, an oath-taking ceremony is scheduled for November 13, 2025, as President Asif Zardari will sign the new amendment.
